It's considered rape if someone, male or female is forced to have sex with someone under threat. In this case, if the slave didn't have sex with the woman, she could threaten to say he raped her, touched her, or even looked at her the wrong way.

The penalty for the man being found out was either being beaten, sold, or killed. To refuse the woman was the greater risk with a certain punishment.
